Website Service Agreement ("WSA")

This agreement outlines the terms and conditions under which WebWyze will provide Website Services to the Customer.
Scope of Services
WebWyze will build a Website based on the description and direction provided by the Customer through the related sign-up or order process. WebWyze will use a specific set of plugins and the WordPress platform to design and create the website, as determined by Questionnaire Forms filled out by the customer. The Customer will not have administrative access to edit web pages but can create an unlimited number of blog pages at any time using the content management system.
Our Managed WordPress Website Service is a complete solution that covers all aspects of website creation, updates, maintenance, and backups. This means that the Customer can relax while WebWyze handles all the technical details. Our team of experts is dedicated to ensuring that the website is always up-to-date, secure, and running smoothly, including regular security updates to protect the website and its data from potential threats.
The term "Website Services" refers to the building and management of a website for the Customer by WebWyze. This includes the design, creation, updates, maintenance, and backups of the website based on the description and direction provided by the Customer. The services offered by WebWyze are comprehensive, covering all aspects of website creation, and its team of experts is dedicated to ensuring that the website is always up-to-date, secure, and running smoothly.
Our Commitment to Satisfaction: At WebWyze, we prioritize our clients' satisfaction above all else. We understand the importance of a website to your business, and we're committed to delivering a product you love. Here's our promise to you:
- Full Refund Guarantee: WebWyze guarantees a full refund if you are not satisfied with our services for any reason within the first 30 days, no questions asked. We believe in our work, and we want you to feel confident in your decision to work with us.
- Claiming the Refund: To claim a refund, simply contact your account representative within the 30-day period.
- No Setup Fees & No Long-Term Contracts: We don't charge any setup fees, ensuring you get the best value for your investment. Additionally, we believe in earning your business every day. That's why we don't lock you into long-term contracts. You're free to make the best decisions for your business at all times.
- Unlimited Design Revisions: We'll work with you until your website looks and functions exactly how you envisioned. We offer unlimited design revisions for your website project until the website launch to ensure you're thrilled with the final product.
- All-Inclusive Service: Hosting, Security, Accessibility, & Local Insights are all included in all plans ensuring a comprehensive solution for your online presence.
- Loyalty Reward: After two consecutive years of service (24 paid months), the Customer can request a new website facelift at no cost. It's our way of saying thank you for your continued trust and partnership.
- Free Domain Name: As part of our service packages, every plan includes the option for a complimentary new domain name registration (.com, .co, .net, or .org) for the first year. Following the initial year, the domain renewal fee of $19.99 per annum will be automatically charged to the payment method associated with your account.
Customer Obligations
- Complete any questionnaires required by WebWyze.
- Ensure the accuracy of materials provided by WebWyze.
- Approve the content of pages created by WebWyze.
- Includes Google Business Profile Set-up & Postings for Single Locations.
- Respond promptly to requests needed for the project to progress in a timely manner.
- Maintain the blog pages created by customer.
Customer's License and Rights
The Customer grants WebWyze and its vendors and subcontractors the necessary rights and licenses with respect to the Customer's Website or logo created by WebWyze to fulfill its obligations under this Agreement. WebWyze may make a reasonable number of backup copies as deemed necessary.
Unlimited Support
WebWyze's dedication to client success extends beyond the initial website design and deployment phase. The Website Services plans encompass a comprehensive support structure, ensuring client websites remain updated, operational, and in line with their business objectives. The term 'unlimited', as used within this context, pertains to the frequency of support interactions, not the expansiveness of tasks.
Included Services:
- Unlimited Phone Support: Clients are entitled to phone support during WebWyze's official business hours. Kindly refer to the SLA under the section "WebWyze Responsibilities" for our official business hours.
- Maintenance Updates: Support includes updates to existing web pages, such as contact detail modifications, image replacements, minor content adjustments, and typo rectifications. Notably, extensive content revisions fall outside this scope and are governed by the Content Development Tiers
Service Illustrations:
- Simple Adjustments: For example, upon relocating an office, WebWyze will facilitate the address update on the client's contact page. Similarly, promotional banners can be integrated upon client request.
- Content Modifications: Minor alterations, like updating a product feature, are covered. However, comprehensive content overhauls, such as revamping an entire product page, fall outside this support scope.
Operational Hours & Response Commitment: For details on operational hours and response times, kindly refer to the SLA under our "WebWyze Responsibilities" section.
Service Limitations:
- Major Content Alterations: Comprehensive content changes are categorized under the Content Development Tiers.
- Specialized Design, Development, & eComm Services: Significant design changes, overhauls, custom web development, 3rd party support, or e-commerce integrations are categorized under the Specialized Service Rates.
WebWyze values client feedback and remains unwavering in our commitment to deliver exceptional support. We aim to ensure that our clients' online platforms epitomize excellence. Should there be any questions or need for clarification regarding our support structure, clients are strongly encouraged to reach out.
Specialized Service Rates
Notwithstanding the provisions of our "Unlimited Support," certain tasks require specialized expertise and are not covered under "Unlimited Support" or "Content Development Tiers". The rates for these specialized tasks are as follows:
- Standard Hourly Services:
- Rate: $73/hour
- Scope: Specifically includes UI/UX Design and Web Development tasks or Standard WordPress Tasks.
- Standard WordPress Tasks may encompass but not limited to:
- Theme Customizations
- Menu Adjustments
- Widget Management
- Page Layout
- Typography Updates
- HTML Updates
- Cascading Style Sheets (CSS) Adjustments
- Standard WordPress Tasks may encompass but not limited to:
- Programming Hourly Services:
- Rate: $123/hour
- Scope: Tasks related to non-supported plugin installations, custom JavaScript, custom PHP, and custom plugin development.
- Custom Hourly Services:
- Rate: $173/hour
- Scope: This encompasses tasks associated with 3rd Party Support, custom e-commerce integrations, and Software Requirements Specifications (SRS). It also includes the creation of either Comprehensive or Technical Statements of Work (SOW). While we specialize in these areas, general e-commerce services are not included in our standard marketing plans. However, they can be provided upon request for an additional fee.
Billing Information and Statement of Work (SOW):
All specialized services are billed with a minimum of one hour. Subsequent time is billed in half-hour increments. For example, a task taking 1 hour and 20 minutes will be billed for 1.5 hours.
For certain tasks, depending on their complexity and size, WebWyze may provide a Basic Statement of Work (SOW) outlining the specific deliverables, timelines, and associated costs. In such cases:
- Payment terms may be structured to require a portion of the total cost (typically 50%) to be paid upfront, with the balance due upon completion of the task.
- Specific billing terms, if different from the standard, will be detailed within the SOW.
For smaller tasks where an SOW is deemed unnecessary by WebWyze, the client will be billed upon the task's completion. It remains at the sole discretion of WebWyze to determine the necessity of an SOW based on the size and complexity of the task.
Additional Billing Information:
For tasks related to the creation of new pages or significant content revisions, charges will be in accordance with our "Content Development Tiers". "Unlimited Support" is limited to routine updates and minor changes and explicitly excludes major redesigns, extensive development, e-commerce setups, technical documentation, and 3rd party vendor support.
All rates mentioned herein are standard, but any work beyond regular monthly maintenance will be quoted separately. Clients will be informed of any potential costs in advance.
Content Development Tiers
As part of our commitment to providing professional website solutions, we offer three distinct content development tiers, referred to as "Developed Content," to cater to varying client needs. These tiers apply in the following scenarios:
- Adding Additional Pages: If you wish to include more pages beyond the number specified in your initial plan.
- Post-Launch Page Creation: If you decide to add a new webpage after your site has gone live.
- Major Content Revision: If you want to make significant revisions to the content of an existing page.
Note: Minor content revisions are offered for free as part of our unlimited website support.
Each tier covers content development for up to 500 words per page. Additionally, every page we develop includes the following features:

Each tier covers content development for up to 500 words per additional page:
- Content Assist:
- One-time Fee: $79 per page.
- Client Responsibilities: The client agrees to provide 100% content specifics (word-for-word content) for each page.
- Our Responsibilities: We will assist with adjustments to the provided content to ensure optimal SEO and page layout.
- Content Direction:
- One-time Fee: $89 per page.
- Client Responsibilities: The client agrees to provide 50% foundational content for each page.
Our Responsibilities: We will build upon the client's foundational content, ensuring the content is optimized for both SEO and page layout.
- Content Creation:
- One-time Fee: $99 per page.
- Client Responsibilities: While our team handles the primary content development, the client may be asked to provide specific insights, preferences, or details via a content questionnaire web form to ensure the content aligns with their vision and needs.
- Our Responsibilities: We will handle everything from content research to final content creation, ensuring it's optimized for SEO and page layout.
In addition to the 3 Content Development Tiers outlined above, we recognize that there may be instances where a website does not require an additional page but rather a comprehensive update to its existing material. For a full-scale content overhaul that revitalizes the existing pages without expanding the page count (up to 500 words), we offer a specialized service at a rate of $49.50 per existing page. This Content Revision service is designed for those pages that need a significant refresh to stay current with your brand, message, or business strategy, ensuring that your content remains engaging and effective without the need for adding new pages to your website. This fee reflects our commitment to maintaining the highest quality and relevance of your website's content.
Note: Specific fees associated with each content development tier are detailed in "The Email" sent to you from WebWyze, which outlines the features, services, and price to be deployed to your domain name.
Content Management
- Website Content: The Customer acknowledges that WebWyze provides a managed website service, where the design and content creation is handled by WebWyze. The Customer may add, edit, and delete blog content using the easy-to-use editor provided by WebWyze and may only add HTML content and upload images. All other pages and content will be provided and managed by WebWyze as directed by Client.
- Editor Usage: The Customer agrees to use the editor in accordance with the terms and conditions outlined in this agreement. Modifications or changes made outside of the editor may result in the loss of content or affect website functionality.
- Responsibility: The Customer understands that any content they add, edit, or delete through the editor is their sole responsibility. WebWyze will not be held liable for errors or inaccuracies in the content added by the Customer.
Ownership of Customer's Content
- Customer acknowledges that all Content provided by them to WebWyze for inclusion on the Website, is owned by the Customer or that they have a legal right to such Content.
- Customer is responsible for ensuring that all Content and its use do not violate the WebWyze Acceptable Use Policy (AUP).
- Customer is responsible for any and all claims related to the Content.
- WebWyze will not be responsible for any legal issues related to the Content.
Termination of Services
Either party may terminate this agreement upon written notice to the other party if the other party breaches any material term or condition of this agreement. This agreement constitutes the entire understanding of the parties and supersedes all prior understandings and agreements between the parties, whether written or oral, relating to the subject matter of this agreement. By using the Website Services provided by WebWyze, the Customer agrees to be bound by the terms of this Website Service Agreement.
- General Termination:
- If the Customer wishes to terminate the services without opting for a buyout, a written notice of at least 30 days is required. This notice should be sent via email to our customer support team.
- If the termination is made before the end of a billing cycle, no refunds will be provided for the remaining days of that cycle.
- After the 30-day trial, an early cancellation fee of $300 applies to services canceled before completing 6 months of service.
- By WebWyze:
- WebWyze reserves the right to terminate the agreement under certain conditions, such as non-payment or violation of our Acceptable Use Policy (AUP). Clients will be given a 30-day written notice in such cases, except in instances of severe violations of the AUP where immediate termination may be necessary.
Website Ownership and Buyout
- What is a Website Buyout?: A website buyout is an option available to customers who wish to terminate their services with WebWyze but want to retain ownership of their website. By exercising the buyout option, the Customer obtains full ownership rights of the website, including all its content and associated assets. However, the Customer will also be responsible for managing all aspects of the website, including but not limited to, securing and maintaining hosting, ensuring website security, and managing all updates and maintenance, after the buyout. Additionally, the Customer will be responsible for any licenses of plugins, as these do not transfer with the buyout. This means that while the services with WebWyze are terminated, the Customer can take the website, host it elsewhere, or manage it independently, but they will need to ensure all necessary licenses are in place.
- Buyout Process: Upon exercising the buyout option and fulfilling all financial obligations, the customer will be issued a Website Ownership Certificate by WebWyze. This certificate serves as formal documentation of the transfer of ownership and delineates the responsibilities and services that will no longer be provided by WebWyze, ensuring a clear and transparent transition of website management and ownership to the customer.
- Buyout Fee: The fee for website ownership rights is $700. This buyout option is available only after fulfilling a minimum of 6 months of continuous service with WebWyze, with no missed or late payments. If you wish to exercise the buyout option before completing the 6 months of service, the remaining balance for the 6-month service period must be paid in full, in addition to the $700 buyout fee. The buyout fee is not subject to proration or reduction regardless of the duration of service with WebWyze beyond the initial 6-month period.
- Payment Conditions: The Customer must be current with their payments and not in default of the Agreement to obtain ownership rights.
- Ownership Model: The website operates on a lease-to-own model and remains the property of WebWyze until a buyout has been fulfilled.
- Acknowledgment: The customer acknowledges and agrees to these terms related to website ownership and buyout.
WebWyze Footer
- Customer agrees that the text and/or image footer link "Site by WebWyze" will appear on the completed site. The customer may choose to exclude or permanently remove the footer from its website at any time, subject to an additional one-time payment to WebWyze in the amount of $759.00 USD. This payment can be made at any time after the website has gone live and must be completed prior to the removal of the footer.
